By creating a store, accessing our platform, or using our services, you ("Merchant", "Store Owner", or "User") agree to be legally bound by these Terms of Service.

1. Store Eligibility & Merchant Registration

To register and operate a digital storefront on VyaparLink:

You must be at least 18 years of age and legally eligible to enter into commercial contracts under the Indian Contract Act, 1872.
You must provide accurate, verifiable business information including your legal name, active WhatsApp phone number, and valid email address.
You are solely responsible for maintaining the confidentiality of your account credentials, login codes (OTPs), and administrative dashboard sessions.

Strictly Prohibited Listings Include:

Counterfeit & Fake Designer Goods: Unauthorized replicas of branded apparel, luxury handbags, footwear, cosmetics, or electronics bearing third-party logos.
Pirated Digital Goods & Software: Cracked APKs, unauthorized VPN subscriptions, pirated software keys, or stolen streaming account credentials.
Unauthorized Media & Content: Bootlegged movies, courses, e-books, or musical recordings without certified copyright holder distribution rights.
Misleading Trademark Usages: Using trademarked brand names (e.g. Nike, Gucci, Apple) in store names or product titles without authentic authorization.

Immediate Permanent Account Suspension & Zero Refund:

Any store reported or detected with infringing or counterfeit listings will face immediate, permanent termination of their storefront and admin dashboard access. All subscription fees paid are strictly forfeited without refund, and offending merchant data may be disclosed to legitimate trademark holders and law enforcement authorities under the Indian Copyright Act, 1957 and Information Technology Act, 2000.

4. Platform Intellectual Property Rights

All technology, algorithms, multi-tenant database architectures, user interface designs, logo graphics, and proprietary software underlying VyaparLink.in are the exclusive intellectual property of VyaparLink and founder Aamir Sohail. Users may not copy, reverse engineer, decompile, or create unauthorized derivative platforms from our code.

5. Merchant Independence & Customer Transactions

VyaparLink operates strictly as an infrastructure technology provider (SaaS). We provide the software enabling you to showcase catalogs and accept WhatsApp orders. Consequently:

All buyer-seller agreements, product guarantees, delivery timelines, physical packaging, and quality assurances are strictly between the Merchant and their retail customers.
VyaparLink does not hold customer escrow funds, operate delivery courier fleets, or participate in physical product disputes.
Merchants must accurately generate receipts and fulfill consumer protection obligations under the Consumer Protection (E-Commerce) Rules, 2020.

6. Prohibited Commercial Activities

In addition to intellectual property violations, stores may not be used to sell narcotics, prescription drugs without license, firearms, gambling schemes, adult content, or goods prohibited under the laws of the Republic of India.

7. Governing Law & Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of India. Any legal dispute, arbitration, or claim arising under these terms shall be subject to the exclusive jurisdiction of the competent courts in Ahmedabad, Gujarat, India.
